User Agreement and Refund Policy

TERMS AND CONDITIONS (“TERMS”) Please read these terms and conditions (“Terms”, “Terms”) carefully before using the http://openartacademy.com website (the “Service”) operated by Open Art Academy( “we” or “our”). Your access to and use of the Service is subject to your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and other persons who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of the terms, you may not access the Service.

ACCOUNTS When you create an account with us, you must always provide us with accurate, complete and up-to-date information. Failure to do so is a violation of the Terms, which may result in the immediate termination of your account on our Service. You are responsible for safeguarding the password you use to access your private student account and for any activity or activity under your password, whether your password is from our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. By sending us an application, you agree to the fact that we have the right to send to your e-mail address or messenger information about news of the Academy and offers that may be relevant to you. You can opt out of this newsletter by unsubscribing.

TERMINATION We may terminate or suspend your access to our Service immediately, without notice or liability, for any reason, including, without limitation, if you violate the Terms. GOVERNING LAW These Terms are governed by and construed in accordance with the laws of Ukraine, without regard to conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of those rights. If any provision of these Terms is held by a court to be invalid or unenforceable, the other provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and supersede any prior agreements we may have had between us regarding the Service.

CHANGES We reserve the right, at our sole discretion, to change or replace these Terms at any time. If the revision is material, we will endeavor to provide notice at least 30 days before any new terms become effective. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after these changes become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

RETURN AND MONEY POLICY

Thank you for being with Open Art Academy. Please read this policy carefully. This is Open Art Academy’s Return and Refund Policy.

DIGITAL PRODUCTS
We refund money for digital products within 30 days from the moment of receiving the Application, only if the person did not use the digital product (specification to the word did not use – did not open, did not view the material – lesson viewing statistics are on the Academy platform). We do not issue refunds if there are product reviews.

In the event that the quality of the Services is inappropriate for the Customer for any reason, the Contractor grants the Customer the right within 14 (fourteen) calendar days from the start of the Program, access to which was granted in accordance with the terms of the Agreement, to contact the Contractor with an Application for the return of the paid funds The request for a refund is sent by the Customer to the address oartacademy@gmail.com. The Customer is responsible for the correctness of the data specified in the Application. The refund application must contain the following information:

Surname, first name, patronymic of the Customer;
The postal address at which the Customer registered,
Method, date and amount of payment for Services;
Reasonable reasons for which the Customer believes that the Service was provided of inadequate quality;
Bank details for refund.
Provided that the Application for refund meets the requirements of paragraph 1.-4. of this Agreement, the Contractor shall return the paid funds within 30 (thirty) calendar days from the date of receipt of the Application. Refunds are made after deduction of commissions of payment systems and to the card from which the payment was made.
In the absence of an Application for a refund, or providing inaccurate information, the Contractor has the right to refuse the Customer a refund.
Any claims, statements sent by the Customer after the expiration of 14 (fourteen) calendar days from the date of the start of the Program, are not considered by the Contractor.

INTELLECTUAL PROPERTY RIGHTS
All online classes (webinars, trainings) in the form of speeches, lectures, speeches; audio and video practices, audio and video lessons, recordings of online broadcasts in the form of audiovisual works, phonograms and videograms, photographic works, images, articles and any other materials received by the Customer in fulfillment of the terms of this contract (hereinafter – Materials) are objects of intellectual property rights and are subject to protection.

Copyright and related rights to the Materials to which access is provided to the Customer belong to the Contractor. The Customer is granted only the right to use the Materials exclusively for personal non-commercial purposes.

Copying, reproduction, distribution, performance, public notification, display, display, use, translation, processing, adaptation and any similar changes of the Materials without the prior written consent of the Performer is prohibited in any way.

The parties agree that the law of Ukraine applies to the relations between them based on this Agreement.
